Addendum to the Terms of Service
ProForged Hiring Terms

These Hiring Terms cover ProForged Hiring (the "Hiring Service") offered by Proforged ("we", "us"). They add to our Terms of Service and Privacy Policy. If anything here conflicts with those, these Hiring Terms win for the Hiring Service. By starting a hire you agree to them on behalf of your business.
1. What we do
You tell us about a role. We build a job page for it under your business name, place ads for it, phone-screen every applicant, send you a short list with scorecards and recordings, and book interviews into the windows you give us. You decide who to interview and who to hire. We never hire anyone on your behalf and we never promise that a hire will happen, or by when.
2. Two plans
Per hire: $1,500 for each person you hire through the Hiring Service. There is no deposit and no monthly fee.
Always Hiring (retainer): $499 per month, billed monthly in advance, plus $500 for each person you hire while the retainer is active. Screening is unlimited across your open roles. The retainer is month-to-month; cancel any time and it stops at the end of the paid month. Hires made while the retainer was active are billed at the retainer rate even if the charge lands after you cancel.
3. Pay on hire: how the card works
We save a card when you start a hire. We do not charge it up front. The per-hire fee is charged to that card when either of these happens, whichever comes first:
- You mark someone as hired in your portal (or tell us to), or
- Three business days pass after the start date you recorded for an applicant, and you haven't told us the hire fell through.
We email you before an automatic charge. If a charge fails we retry over the next three days, email you, and pause new screening on that job until it's sorted out. You can update the card in your portal at any time.
4. What's included in the fee
Job advertising is included in the per-hire fee up to $300 per hire. If a role needs more than that, we'll pause and ask before spending it; anything you approve beyond $300 is billed at cost, with no markup. On Always Hiring, job advertising is included in the monthly fee (up to $300 per open role per month; we'll ask before going beyond that). Phone screening, scorecards, interview booking, and reminders are included in both plans. Background checks are available on request through Checkr (see section 10) and, once our Checkr account is live, one Basic+ criminal check per hire is included; upgraded screenings are billed at Checkr's cost with no markup.
5. No hire, no charge
If you don't hire anyone from a job, you owe nothing for that job on the per-hire plan. We may close a job that has been open 60 days with no interviews scheduled, and we'll tell you first.
6. 30-day replacement
If a person you hired through the Hiring Service leaves, or you let them go for cause, within 30 days of their recorded start date, we will run the job again at no additional fee: reopen the job page, re-run the ads (up to the same $300 included), screen new applicants, and book new interviews. This is one free rerun per hire. It is not a refund, and it does not apply if the role was eliminated, the pay or schedule changed after the hire, or the person was let go for reasons other than cause. Tell us within 7 days of the person leaving.
7. Who our client is
You are our client. Applicants are not. We never charge applicants anything, and we never take a cut of anyone's wages. Ads and the job page say the job is with your business, with a small "Hiring powered by ProForged" note.
8. Recorded, automated calls
Applicants are called by an automated phone assistant shortly after they apply. Every call starts by saying that it's recorded and automated, and applicants consent to being texted and called when they apply. Recordings and transcripts are shared with you for hiring purposes only. Don't share them outside your business.
9. What we ask, and what we won't
Our screening questions are fixed and cover availability, transportation, experience, certifications the role lists, pay expectations, start date, and one situational question. We do not ask about, and will not screen on, age, family status, pregnancy, religion, national origin, citizenship beyond work authorization, disability, health, or arrest history. If your job description or dealbreakers touch any of those, we'll ask you to reword them before the job goes live. You are responsible for your own hiring decisions and for complying with employment law where you operate.
10. Background checks
Background checks are run through Checkr on request (one Basic+ criminal check per hire is included once our Checkr account is live). We request it after you pick a finalist (shortlisted, interviewing, or hired). Checkr — an FCRA-compliant consumer reporting agency — hosts the disclosure and collects the applicant's separate written consent and any information the check needs; we never ask for or store a Social Security number or date of birth. You see the status and result in your portal. If you decide not to move forward because of what a report shows, the pre-adverse and adverse-action notices go through Checkr's process, not ours. Additional or upgraded screenings beyond the included package are billed at Checkr's cost, with no markup. We never use people-search websites to look up applicants, and we ask you not to either.
11. Applicant information
Applicant names, phone numbers, recordings, transcripts, and answers are used only to fill your job. We delete an applicant's information 90 days after the job closes unless you hired them, in which case we keep a record of the hire for billing and the replacement window. You may keep what we've sent you for your own hiring records, and you agree to protect it the way you'd protect any personal information.
12. Where we operate
The Hiring Service is available nationwide. Some states have their own rules for services that help employers hire, and in those states we verify what applies before a job goes live. That never stops you from starting a hire; it may delay ads by a few days. If we can't run a job in your state, we'll tell you and nothing is charged.
13. Your part
Post a real job at real pay, keep the interview windows you set (or tell us when they change), show up for booked interviews, and mark hires when they happen. Give us accurate information about the role and the business.
14. Changes and questions
We may update these Hiring Terms; the date at the top tells you when. Changes don't affect a charge already made or a replacement window already running. Questions go to support@proforged.io.
